The U.S. Supreme Court granted a major procedural victory to the Trump administration on Friday, allowing its bid to end automatic birthright citizenship to advance—albeit in limited form. The court’s 6–3 decision narrows the reach of nationwide injunctions, permitting the executive order to apply only to plaintiffs directly involved in the lawsuits.
While the decision does not address the constitutionality of the proposed policy, it removes a procedural barrier that has stalled implementation. Lower courts and plaintiffs’ legal teams are expected to swiftly contest its narrower scope.
Shortly after the ruling, President Trump praised the decision at the White House, calling it “a monumental victory for the Constitution, the separation of powers and the rule of law,” while critics warned it may concentrate excessive power in the hands of the president.
Justice Amy Coney Barrett, writing for the majority, clarified that injunctions must now be limited “only to the extent that the injunctions are broader than necessary,” urging lower courts to revise existing orders accordingly.
In dissent, Justice Sotomayor criticised the decision as a “travesty for the rule of law,” warning it gives “an open invitation to bypass the Constitution,” while Justice Jackson termed it an “existential threat to the rule of law.”
With the executive order poised to take effect in 30 days, litigation is expected to shift to class-action suits. The American Civil Liberties Union described the ruling as “troubling but limited,” and New Jersey’s Attorney General expressed confidence that the policy will ultimately be blocked.
Legal analysts note that nationwide injunctions have become more common in recent years, and this ruling could empower future efforts to limit their application.
